1. Acceptance of Terms
By accessing or using the Opsmith website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms constitute a legally binding agreement between you and Opsmith.
2. Services
Opsmith provides automated lead recovery and follow-up services for trade businesses in Australia. Our services include:
- Automated SMS and email lead response systems.
- Lead capture form setup and integration.
- Follow-up sequence automation over 7 days.
- Lead management dashboard access.
- Calendar integration for appointment booking.
- Initial setup, configuration, and training.
3. Pricing and Payment
- The one-time setup fee is $2,500 - $3500 AUD, payable prior to commencement of work.
- Monthly service fees of $300 AUD cover SMS credits, email delivery, and ongoing support.
- All prices are in Australian Dollars (AUD) and are inclusive of GST where applicable.
- Payment terms and methods will be outlined in your individual service agreement.
4. Money-Back Guarantee
We offer a 30-day money-back guarantee on the setup fee. If you are not satisfied with our service within the first 30 days of your system going live, contact us for a full refund of the setup fee. Monthly service fees are non-refundable once the billing period has commenced.
5. Your Responsibilities
As a user of our services, you agree to:
- Provide accurate and current business information.
- Comply with all applicable Australian laws regarding SMS and email marketing, including the Spam Act 2003.
- Ensure you have appropriate consent from your leads before automated follow-up communications are sent.
- Not use our services for any unlawful, fraudulent, or harmful purpose.
- Maintain the confidentiality of your account credentials.
6. Intellectual Property
All content, branding, and materials on the Opsmith website are the property of Opsmith and are protected by Australian intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.
7. Limitation of Liability
To the maximum extent permitted by Australian Consumer Law, Opsmith shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim. Nothing in these terms excludes or limits any rights you may have under the Australian Consumer Law.
8. Service Availability
While we strive for maximum uptime, we do not guarantee uninterrupted availability of our services. We may perform scheduled maintenance or updates that temporarily affect service availability. We will provide reasonable notice of any planned downtime.
9. Termination
Either party may terminate the service agreement with 30 days written notice. Upon termination, your access to the dashboard and automated systems will be deactivated. Any data you have provided can be exported upon request within 30 days of termination.
10. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Australia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Australia.
11. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on this page. Your continued use of our services after any changes constitutes acceptance of the new terms.
